Italy’s Data Watchdog Seeks More Transparency of ChatGPT’s OpenAI to Lift Ban

Italy’s data protection agency Garanate has set out multiple conditions for OpenAI to implement and comply with the GDPR rules.

In March 2023, the European Nation of Italy announced a ban on OpenAI’s newly released told ChatGPT, which has created a storm in the tech world. This happened on the charges of breaching data privacy rules in Italy.

In the latest development, Italy’s data protection agency Garanate suggested certain actions that OpenAI must take in order to revoke the imposed ban. Earlier this month, the Italian watchdog suspected that the ChatGPT platform violated the European Union’s General Data Protection Regulation (GDPR).

Thus, it asked the US-based firm to stop the processing of data belonging to all individuals residing in Italy. As per the recent press release from Garante, OpenAI must increase transparency and issue an information notice while comprehensively outlining its data processing practices.

Furthermore, it also requires OpenAI to implement age-gating measures immediately in order to prevent minors from accessing the technology. Garante also wants OpenAI’s ChatGPT to implement more stringent verification methods.

Italy’s data protection agency noted that OpenAI should specify the legal grounds it relies upon for processing individuals’ data to train the AI. The regulator adds that OpenAI should choose between offering user consent or relying on legitimate interests. As per their current privacy policy, OpenAI seeks to give more weight to the performance of the contract upon providing services such as ChatGPT.

Italy Asks for Better User Protection and Choices

The Italian regulatory agency added that OpenAI should allow users as well as non-users to exercise their rights regarding personal data. This includes requesting corrections for any misinformation generated by ChatGPT or deleting their data.

Furthermore, Garante wants OpenAI to allow users to object to processing their data or train its algorithm. It also wants OpenAI to conduct awareness campaigns in Italy to inform individuals they are processing the user information to train its AIs.

In order to complete all of the above-mentioned tasks, OpenAI has set a deadline of April 30 for OpenAI. Also, OpenAI will get an extended timeline of up to May 31, for submitting a plan that outlines the implementation of age verification technology, and screens out users all under 13 years.

This is the first major regulatory challenge that OpenAI is facing after the release of its ChatGPT chatbot system in the market.
