Amazon Web Services (AWS) said in the filing that it wants to depose President Donald Trump, Defense Secretary Mark Esper and former Defense Secretary James Mattis over a $10 billion Pentagon’s JEDI contract awarded to Microsoft.
Amazon Web Services (AWS) spokesperson blames United States President Donald Trump for using his executive powers in order “to advance his personal agenda.” They also claim that the example of this was awarding of the $10 billion Joint Enterprise Defense Infrastructure (JEDI) cloud infrastructure deal to Microsoft Corp. and not Amazon.com Inc.
Per the official statement:
“The question is whether the President of the United States should be allowed to use the budget of the DoD [Department of Defense] to pursue his own personal and political ends.”
Additionally, AWS said in court documents it wants seven individuals, which it deems “instrumental” in the Pentagon deal process, to testify under oath. It called out Trump, former Defense Secretary James Mattis and his successor Mark Esper, among others.
Trump Interfered with Government Functions to Advance Personal Agenda
A spokesperson for AWS added:
“President Trump has repeatedly demonstrated his willingness to use his position as President and Commander in Chief to interfere with government functions, including federal procurements, to advance his personal agenda.”
The White House still didn’t respond as well as the Representatives from the Defense Department. Microsoft also refused to comment.
As already mentioned, the Joint Enterprise Defense Infrastructure – JEDI cloud computing contract is estimated at approximately $10 billion for all the duties performed for more than 10 years. The Pentagon chose Microsoft over Amazon for the huge contract on October 25. Amazon was at first the alleged favorite for winning the tender. However, in July Trump stated that he was looking into the contract after IBM and other companies protested the whole bidding process.
‘JEDI has Deficiencies, Errors and Unmistakable Bias’
In November, Amazon filed a notice in the U.S. Court of Federal Claims in order to deny the Pentagon’s resolution to give the multi-billion-dollar cloud contract to Microsoft. Amazon then said that the JEDI evaluation process had “clear deficiencies, errors, and unmistakable bias.”
In December, Amazon claimed Trump initiated “behind-the-scenes attacks” against the company. That resulted in losing the JEDI contract.
AWS said it’s looking to dismiss Trump’s involvement in the bidding process explaining that:
“While other individuals can testify about specific conversations he had with them individually, President Trump is the only individual who can testify about the totality of his conversations and the overall message he conveyed.”
AWS also claims Mark Esper intervened in the JEDI award process to “conduct an ‘examination’ at President Trump’s behest.” Just for reminder, in August last year, Esper announced that he would reexamine the JEDI contract and excused himself from the JEDI source selection process. That was pretty suspicious to AWS who then pledged to seek more details about this.
Bezos and Trump Are Not Really BFFs
To say that Jeff Bezos and Trump don’t like to play along – would be pretty optimistic. Let’s just mention that the billionaire is the owner of The Washington Post, frequently criticized by Trump in his tweets.
Trump also claims that Amazon hasn’t been paying its taxes and that it imposes on the U.S. Post Office.
Amazon’s AWS chief, Andy Jassy said already in December last year that the cloud contracting was not adjudicated fairly.
“You know, there was significant political interference here. When you have a sitting president who’s willing to be very vocal that they dislike a company and the CEO of that company, it makes it difficult for government agencies”, said he.
